Actuality Systems (www.actuality-systems.com) is a company dedicated to developing cutting edge 3D displays for multiple uses including healthcare (diagnostics & surgery), geology, exploration and engineering. In its infancy, the R&D and manufacturing firm had taken advantage of a glut of high-end office space and was located on the third floor of one of Burlington's most prestigious office buildings. It's lathes and drill presses were tolerated by the landlord but it was apparent that Actuality would need a more traditional "flex" building now that its production was starting to ramp up. After developing criteria and touring the appropriate sites, the 10,303 square foot suite at the newly renovated 213 Burlington Road in Bedford MA became as its facility of choice. Requests for proposals were sent to the building's owner and two other landlords in Bedford and Burlington. The initial offer from 213 Burlington Road was $12 per square foot per annum on a "triple net" basis, no free rent, no right to terminate the five-year lease, $25 per square foot in tenant improvements (TI), a security deposit of twelve months, no expansions rights and no liquidated damages in the case of non-performance by the landlord. The transaction negotiated by Equitable Real Estate Solutions resulted in rent of $9.50 with $.50 annual increases, three months of free rent, a right to terminate the lease obligation after year three with the only penalty being the unamortized transaction costs, $60 in tenant improvements, three months security deposit and liquidated damages in the event of non-performance by the landlord. The result netted $473,938.00 in savings to Actuality Systems. Further, the right to terminate the lease in year three coupled with the right of first refusal on contiguous space gives Actuality freedom from the worry that its facility might constrain its growth. The three months free rent, nine month reduction in the security deposit and additional $360,605 in the tenant improvement allowance is helping the maturing firm free up its much-needed cash for investment in staff and research and development.
